Terms and Conditions

These Terms and Conditions ("Terms") govern your use of CyberDetect.org's website and services. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services Overview

CyberDetect.org provides cybersecurity services to UK businesses, including:

  • Continuous security monitoring
  • External penetration testing
  • Credential breach monitoring
  • Data leak detection
  • Infrastructure monitoring
  • Security assessments and reporting

All services are subject to a business fit evaluation and mutual agreement before commencement.

2. Business Fit Evaluation

CyberDetect.org reserves the right to evaluate and select clients based on our criteria. We are under no obligation to accept every business that applies for our services. This evaluation process ensures we can provide maximum value and maintain service quality.

The business fit evaluation is complimentary and does not obligate either party to enter into a service agreement.

3. Service Agreement

Upon acceptance, a formal service agreement will be executed detailing:

  • Scope of services to be provided
  • Pricing and payment terms
  • Service level commitments
  • Confidentiality obligations
  • Term and termination provisions

No payment is required until after the business fit evaluation and delivery of a customized security plan.

4. Authorized Testing

All penetration testing and security assessments will be conducted:

  • Only with explicit written authorization
  • Within the agreed scope and timeframes
  • Using ethical hacking methodologies
  • From external perspectives only (unless otherwise agreed)
  • In compliance with applicable laws and regulations

The client authorizes CyberDetect.org to perform these activities and agrees not to pursue legal action for authorized testing activities conducted within the agreed scope.

5. Confidentiality

Both parties agree to maintain strict confidentiality regarding:

  • All security findings and vulnerabilities discovered
  • Business information and infrastructure details
  • Proprietary methods and tools
  • Terms of the service agreement

CyberDetect.org will not disclose client information or security findings to third parties without explicit consent, except as required by law.

6. Limitation of Liability

To the maximum extent permitted by law:

  • CyberDetect.org provides services on an "as is" basis
  • We do not guarantee that all vulnerabilities will be discovered
  • We are not liable for damages resulting from undiscovered vulnerabilities
  • Our liability is limited to the fees paid for services in the preceding 12 months
  • We are not liable for indirect, consequential, or punitive damages

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded by law.

7. Client Responsibilities

Clients agree to:

  • Provide accurate information about their infrastructure and systems
  • Obtain necessary authorizations for testing on third-party systems
  • Not hold CyberDetect.org liable for service disruptions during authorized testing
  • Implement recommended security improvements in a timely manner
  • Maintain backup systems and data recovery capabilities
  • Notify relevant stakeholders of authorized testing activities

8. Intellectual Property

All reports, tools, methodologies, and materials created by CyberDetect.org remain our intellectual property. Clients receive a license to use reports for internal business purposes only.

Clients retain ownership of their data and business information shared with CyberDetect.org.

9. Payment Terms

Payment terms will be specified in the service agreement and may include:

  • Monthly subscription fees for continuous monitoring
  • Project-based fees for penetration testing
  • Retainer arrangements for ongoing services

Late payments may incur interest charges and may result in suspension of services.

10. Termination

Either party may terminate the service agreement:

  • With written notice as specified in the agreement
  • Immediately for material breach of terms
  • Immediately if the other party becomes insolvent

Upon termination, all outstanding fees become immediately due, and confidentiality obligations continue indefinitely.

11. Compliance with Laws

Both parties agree to comply with all applicable laws and regulations, including:

  • UK Computer Misuse Act 1990
  • UK GDPR and Data Protection Act 2018
  • Relevant industry-specific regulations

12. Disclaimer of Warranties

While we strive for excellence, CyberDetect.org makes no warranties that:

  • All security vulnerabilities will be discovered
  • Systems will remain secure after our services
  • Our services will prevent all security incidents

Cybersecurity is an ongoing process, and new threats emerge constantly. Our services reduce risk but cannot eliminate it entirely.

13. Indemnification

Clients agree to indemnify and hold harmless CyberDetect.org from claims arising from:

  • Testing activities conducted within authorized scope
  • Client's failure to implement recommended security measures
  • Client's misuse of our reports or findings
  • Third-party claims related to authorized testing

14. Force Majeure

Neither party is liable for delays or failures in performance resulting from circumstances beyond reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified to existing clients. Continued use of our services after changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with any executed service agreement, constitute the entire agreement between the parties and supersede all prior communications and proposals.
